These Terms & Conditions apply to all quotations, orders, and work performed by McGrath Metal ("McGrath Metal," "we," "us," or "our") for any customer ("Customer," "you," or "your"). By approving a quotation, submitting a purchase order, paying a deposit or invoice, or authorizing McGrath Metal to begin work, Customer agrees to be bound by these Terms & Conditions. Any additional or conflicting terms in Customer's purchase order, email, contract, portal, or other document are rejected unless McGrath Metal specifically agrees to them in a writing signed by an authorized representative.
1. Who We Are and What We Do
McGrath Metal is an in-house precision metal fabrication shop. Our work includes laser cutting, plate and tube cutting, CNC press brake forming, welding (MIG/TIG), media blasting, de-burring, finishing (including powder coating, painting, and patina where offered), machining, assembly, and related metalworking services performed at our Indio, California facility.
McGrath Metal is not a licensed contractor. We do not perform installation, field assembly, site work, structural engineering, field measurement, permitting, or construction-related services unless a quotation expressly states otherwise and the work may lawfully be performed by McGrath Metal. Our normal scope begins and ends with fabrication performed in our shop. If Customer requires installation or on-site work, that work must be arranged separately with a properly licensed contractor.
McGrath Metal is not responsible for design, installation, anchorage, integration, code compliance, structural adequacy, or performance of work performed or specified by others. This limitation does not exclude McGrath Metal's responsibility to fabricate the item in accordance with the approved drawing and the Limited Warranty stated in these Terms.
2. Quotations
• Quotations are valid for the period stated on the quotation, typically 10 days from the quotation date. After expiration, pricing, material availability, and lead time are subject to change without notice.
• Quotations are based solely on the information, drawings, dimensions, quantities, and specifications available when quoted. Any change to quantity, size, specification, material, finish, or scope may require a revised quotation.
• Our scope is limited strictly to the items and services specifically listed and described on the quotation. Site visits, contractor meetings, field measurements, engineering, permitting, consultation, delivery, installation, unloading, coordination with other trades, and all other unlisted items are excluded unless stated, regardless of prior discussion or assumption.
• Customer approval of a quotation does not by itself constitute order acceptance. An order is accepted only when McGrath Metal confirms acceptance in writing and receives the required deposit, prepayment, or approved purchase order.
• McGrath Metal may correct typographical, clerical, mathematical, or pricing errors before or after Customer approval. If a correction materially changes the order, Customer will be notified before production proceeds.
3. Customer-Supplied Information, Shop Drawings & Approval
3.1 Customer-supplied information
All quotations and shop drawings are produced from the dimensions, specifications, images, templates, files, samples, and other information Customer provides. Customer is responsible for ensuring that all supplied information is complete and accurate. McGrath Metal is entitled to accept and rely upon Customer-supplied information as accurate and complete and does not independently field-measure, verify, or engineer it.
Except for a demonstrable transcription or transposition error introduced by McGrath Metal while transferring Customer-supplied information into a McGrath Metal-prepared drawing, the accuracy and adequacy of all information supplied by Customer remain Customer's responsibility.
3.2 Shop drawing production
Based on the information Customer provides, McGrath Metal may prepare a shop drawing reflecting our understanding of the part to be fabricated. For build-to-print work, McGrath Metal may instead use or review Customer's drawing. The applicable drawing is returned or made available to Customer for review.
3.3 Approval required before fabrication
Fabrication of custom or special-order work does not commence until Customer has reviewed and approved the applicable shop drawing or production drawing in writing. Design, detailing, programming, material procurement, scheduling, and other pre-production work may begin before drawing approval where required by the accepted order.
3.4 Effect of approval
By approving a shop drawing, Customer confirms and accepts:
• All design dimensions, measurements, tolerances, hole locations, orientation, quantities, and relationships shown;
• The material, grade, gauge or thickness, finish, and other stated specifications;
• The design's intended fit, form, function, and compatibility with Customer's application; and
• Any structural, architectural, code, regulatory, engineering, or third-party requirements applicable to the intended use or installation.
Once approved, the drawing becomes the sole and final basis for production. McGrath Metal will fabricate to the approved drawing exactly as shown, allowing for any expressly stated tolerance, standard commercial shop tolerances, and normal material and fabrication variation described in Section 7.
Customer remains responsible for errors, omissions, or design deficiencies in Customer-supplied information and in the approved design, except for a demonstrable transcription or transposition error introduced by McGrath Metal when transferring correct Customer-supplied information into a McGrath Metal-prepared drawing.
3.5 Changes after approval
Any revision requested after approval is a change under Section 6 and is subject to additional charges, revised payment requirements, and schedule delay.
3.6 Scanned or reproduced patterns
Where McGrath Metal scans, digitizes, traces, or reproduces a pattern, image, physical template, photograph, sketch, or sample supplied by Customer, Customer represents that it has the right to use and reproduce the design. Customer must confirm that the resulting drawing or cut pattern matches its intent before approving production.
4. Special-Order & Custom Items
Special-order and custom-fabricated items are manufactured, purchased, designed, programmed, and scheduled specifically for Customer and are not stock inventory. Once an order is approved by Customer and accepted by McGrath Metal, it may not be modified, postponed, cancelled, returned, or refunded except with McGrath Metal's written agreement and subject to Sections 5, 6, 10, and 16.
5. Deposits, Prepayment & Credit Terms
5.1 Purpose and application of deposits
Deposits, prepayments, and progress payments are not held solely as security for material. Upon order acceptance, McGrath Metal begins administrative, design, procurement, and production-related work that may include:
• Receiving, reviewing, and writing up the order;
• Reviewing Customer information and resolving missing or conflicting details;
• Producing, revising, and issuing shop drawings;
• Communicating with Customer and obtaining required approvals;
• Creating cut files, programming equipment, planning fabrication, and reserving production capacity;
• Ordering, purchasing, cutting, or committing material and outside services; and
• Performing other administrative, design, scheduling, and pre-production work required for the order.
The reasonable value of this work and the amount of material or other commitments made may equal or exceed the deposit before physical fabrication begins. Customer remains responsible for all authorized work performed, materials purchased or committed, subcontract obligations, and other amounts due under the order, even when those amounts exceed the deposit.
5.2 Cancellation, suspension, or default
For Business Customers, deposits and prepayments are non-refundable after order acceptance except to the extent required by applicable law or expressly agreed by McGrath Metal in writing. If an order is cancelled, suspended, delayed, or breached by Customer, McGrath Metal may apply amounts paid against the reasonable value of work performed, materials purchased or committed, subcontract costs, administrative and programming costs, reserved production capacity, storage, handling, and other recoverable costs or damages. Customer remains responsible for any balance exceeding amounts previously paid. Any refund required after lawful offsets will be issued after those amounts can reasonably be determined.
Consumer Customer deposits and cancellations are governed by Section 16.6, which controls in the event of a conflict.
5.3 Payment and credit
• Purchase orders and credit terms are accepted only from organizations whose credit and payment terms have been approved by McGrath Metal in advance. Credit terms are not automatic and are not implied by a prior order, quotation, correspondence, Customer approval, or prior extension of credit.
• Invoices are due according to the payment terms stated on the applicable quotation, order acknowledgment, or invoice. McGrath Metal may suspend design, procurement, production, shipment, or release of completed work while any required payment is outstanding.
• Past-due balances may accrue a service charge of 1.5% per month or the maximum lawful rate, whichever is less, together with reasonable collection costs and attorneys' fees where recoverable.
• Sales tax, freight, delivery, packing, permits, duties, and other applicable charges are additional unless expressly included. All prices are in U.S. dollars.
• A credit-card processing surcharge may apply to credit-card payments where permitted, properly disclosed, and compliant with applicable law and card-network rules. No surcharge will be imposed on debit or prepaid cards.
6. Lead Time & Changes
• Lead time begins only after order acceptance and receipt of all required payments, specifications, files, drawings, instructions, and approvals.
• Stated lead times are estimates, not guaranteed completion or delivery dates. They may be extended by delayed Customer responses, drawing revisions, material or labor availability, supplier delay, unanticipated major equipment failure despite reasonable maintenance, transportation delay, utility interruption, governmental action, fire, weather, or other circumstances beyond McGrath Metal's reasonable control.
• Any Customer-requested change after order acceptance is subject to additional design, drawing, programming, material, labor, administrative, and subcontract charges. McGrath Metal is not required to proceed with changed work until the change and any required payment are approved in writing.
• A change may require a revised lead time and may affect work already completed or material already purchased.
7. Materials, Tolerances, Workmanship & Appearance
• McGrath Metal fabricates to the tolerance expressly stated on the quotation or approved drawing. Where no specific tolerance is stated, standard commercial shop tolerances appropriate to the material, thickness, part size, and manufacturing process apply.
• No material grade, alloy, thickness, or finish stated as a requirement may be substituted without Customer's written approval. McGrath Metal may use a commercially equivalent mill, brand, source, or supplier where the stated material specification remains unchanged.
• Normal characteristics of raw and fabricated metal are not defects. These may include mill scale, minor surface variation, grain or mill-direction variation, heat tint, weld discoloration, weld-profile variation, minor distortion, edge condition, tool marks, and dimensional movement caused by cutting, forming, welding, blasting, or finishing.
• Samples, photographs, renderings, and prior production are representative only unless the quotation expressly requires an approved control sample.
Natural patinas, Corten or weathering steel, acid-washed steel, raw or uncoated steel, mill-finish material, media-blasted surfaces, and hand-applied finishes are inherently variable. McGrath Metal does not warrant uniform color, exact visual matching, timing or pattern of weathering, oxidation, rust runoff, staining, or identical appearance between separate pieces or production runs.
Applied paint and powder coating are warranted only against peeling or loss of adhesion caused by defective surface preparation or application by McGrath Metal during the applicable warranty period. Finish coverage does not include impact damage, scratching, abrasion, fading, chalking, ultraviolet exposure, chemical exposure, corrosion originating at damaged coating, edge corrosion, substrate contamination, standing water, salt, irrigation, dissimilar-metal contact, or other environmental causes.
8. Shipping, Delivery, Pickup & Risk of Loss
• Unless otherwise stated, shipments are FOB McGrath Metal, Indio, California.
• For shipment by third-party carrier under an FOB-origin or shipment contract, risk of loss passes when the goods are duly delivered to the carrier.
• For Customer pickup, risk of loss passes when the goods are loaded onto or delivered into the possession of Customer or Customer's carrier.
• For delivery performed directly by McGrath Metal, risk of loss passes upon tender of delivery at the stated destination.
• Customer is responsible for providing suitable transportation, restraints, protection, unloading equipment, and personnel. McGrath Metal is not responsible for damage caused by inadequate transportation, loading instructions, restraints, unloading, handling, or storage by others.
• Claims for loss or damage occurring while goods are in the possession of a third-party carrier must be made against the carrier, with reasonable assistance from McGrath Metal where documentation is available.
• Delivery, freight arrangement, unloading, and installation are excluded unless specifically listed and priced on the quotation.
9. Completed Work, Delayed Pickup & Storage
McGrath Metal will notify Customer when an order is complete and ready for shipment or pickup. The balance due remains payable according to the order terms regardless of Customer's delay in collecting, accepting, or arranging shipment of completed work.
Customer must collect completed work or authorize shipment within five business days after written notice that the order is ready. Beginning on the sixth business day, McGrath Metal may assess storage charges of $25 per calendar day for each pallet, crate, or equivalent 4-foot-by-8-foot floor-space unit occupied, with a minimum charge of $25 per calendar day per order.
Oversized, unusually heavy, hazardous, weather-sensitive, or difficult-to-handle work may be charged at a higher reasonable rate reflecting the space, equipment, handling, and risk involved. If McGrath Metal moves completed work to third-party storage, Customer is responsible for the actual transportation, handling, and storage charges in addition to any unpaid order balance.
McGrath Metal will exercise reasonable care while holding completed work but is not an insurer. Storage does not extend the payment date or warranty period. McGrath Metal may move the goods within its facility or to reasonable third-party storage. Unclaimed goods will be handled or disposed of only in accordance with applicable law and any required notice procedure.
10. Ownership of Designs, Programs, Tooling & Customer Property
• Unless otherwise agreed in writing, cut files, nesting programs, machine programs, press-brake programs, manufacturing methods, setup information, jigs, fixtures, and general-purpose tooling developed by McGrath Metal remain McGrath Metal's property, even when setup, design, or programming time was charged to Customer.
• Customer-supplied drawings, files, logos, templates, and physical property remain Customer's property. McGrath Metal may retain copies for order records, repeat production, compliance, and warranty purposes.
• Dedicated tooling belongs to Customer only when the quotation expressly identifies it as Customer-owned tooling and Customer has paid all amounts due for that tooling.
• Unless a written storage agreement states otherwise, McGrath Metal has no obligation to retain programs, files, jigs, fixtures, templates, samples, or tooling for more than 24 months after the most recent related order.
• McGrath Metal does not claim ownership of Customer's underlying brand, design intent, or intellectual property and will not use Customer-supplied designs outside fulfilling Customer's orders, internal records, quality control, or warranty administration without permission.
Customer represents that it has the legal right to provide and authorize use of all drawings, logos, photographs, artwork, templates, trademarks, and other intellectual property supplied to McGrath Metal. For Business Customers, Customer shall defend, indemnify, and hold McGrath Metal harmless from third-party claims arising from McGrath Metal's authorized use or reproduction of Customer-supplied intellectual property, except to the extent the claim results from an unauthorized material modification independently made by McGrath Metal.
11. Inspection, Notice of Claim, Right to Cure & Back Charges
11.1 Initial inspection
Customer must inspect the work promptly upon delivery, pickup, or receipt. Shortages, shipping damage, and readily observable dimensional, material, finish, or workmanship discrepancies must be reported in writing within 30 business days. Installation, alteration, further fabrication, or use of an item constitutes acceptance of readily observable conditions that should reasonably have been identified during inspection, but does not waive a valid claim for a latent defect covered by the applicable warranty.
11.2 Notice and opportunity to inspect
A claim must identify the order, item, and alleged condition and include available photographs, measurements, and supporting information. Customer must preserve the item and provide McGrath Metal a reasonable opportunity to inspect and determine the cause before the item is repaired, altered, removed, discarded, or replaced by others.
11.3 McGrath Metal's first opportunity to cure
For a verified condition for which McGrath Metal is responsible, McGrath Metal must be given the first opportunity, at its option, to repair, alter, remake, replace, or otherwise correct the affected item. Customer shall allow McGrath Metal at least five business days after receipt of complete written notice to inspect the item or propose a corrective plan, together with a commercially reasonable period to perform the approved correction considering urgency, material availability, fabrication time, transportation, and site access.
Where an immediate action is reasonably necessary to protect persons or property from an actual and imminent hazard, Customer may take only the minimum reasonable emergency action required and must notify McGrath Metal as soon as practicable.
11.4 Backcharges, deductions, and work by others
To the maximum extent permitted by law, a Business Customer shall not hire others to correct an alleged McGrath Metal defect, deduct amounts from sums due, impose a back charge, or set off a claim unless McGrath Metal has received complete written notice and has declined to cure, failed to provide a reasonable corrective plan within the period above, or failed to begin or complete an agreed cure within a commercially reasonable time.
Any permitted back charge is limited to the reasonable, necessary, and documented direct cost of correcting the verified condition attributable to McGrath Metal. It does not include Customer or contractor markup, profit, general supervision, schedule impact, acceleration, liquidated damages, loss of use, removal or reinstallation costs, or other indirect or consequential amounts unless McGrath Metal expressly agrees in writing or applicable law does not permit exclusion.
Unauthorized repair, alteration, removal, or replacement may prevent McGrath Metal from determining the cause and may exclude the altered condition and resulting damage from warranty coverage. This provision does not restrict non-waivable rights of a Consumer Customer under Section 16.
12. Cancellation
Standard stock orders may be cancelled before production or procurement begins only at McGrath Metal's discretion and subject to payment of all costs incurred. Special-order and custom work is governed by Sections 4 and 5. No cancellation is effective unless accepted by McGrath Metal in writing.
13. Limited Fabrication & Workmanship Warranty - Business Customers
This Section applies to Business Customers. Consumer Customers are governed by Section 16.
13.1 Coverage period and covered conditions
McGrath Metal warrants for one year from the date of shipment or will-call pickup that fabricated work will:
• Conform to the approved drawing, allowing for stated tolerances, standard commercial shop tolerances, and normal material and fabrication variation;
• Conform to the material grade, alloy, thickness, and finish expressly stated in the accepted quotation or approved drawing; and
• Be free from defects caused by McGrath Metal's workmanship.
13.2 Exclusive remedy
Upon timely written notice, substantiation of the claim, and a reasonable opportunity to inspect, McGrath Metal's sole and exclusive obligation is, at its option, to repair, alter, reperform, remake, or replace the affected item, or issue a credit or refund not exceeding the amount paid for that specific affected item. The warranty does not restart after a repair or replacement; the repaired or replacement item remains covered for the balance of the original warranty period unless McGrath Metal agrees otherwise in writing.
Unless installation was expressly included in the accepted quotation, the warranty does not include field labor, access, scaffolding, removal, transportation, reinstallation, refinishing of surrounding work, restoration of buildings or equipment, or correction of work performed by others.
13.3 Exclusions
The Business Customer warranty does not cover:
• Customer-supplied materials, designs, drawings, files, dimensions, specifications, or instructions;
• Suitability, fitness, structural adequacy, engineering, code compliance, or performance for an application not expressly accepted by McGrath Metal in writing;
• Installation, anchorage, integration, alteration, drilling, cutting, welding, repair, or modification performed by others;
• Improper transportation, unloading, handling, storage, maintenance, cleaning, or use;
• Abuse, accident, impact, overload, abnormal vibration, abrasion, ordinary wear, or use outside disclosed conditions;
• Corrosion, oxidation, or finish deterioration caused by moisture, standing water, irrigation, salt, chemicals, coastal or industrial exposure, dissimilar-metal contact, damaged coatings, or environmental conditions;
• Natural variation in raw metal, mill finish, weld appearance, grain, patina, Corten or weathering steel, acid wash, media blast, color, texture, sheen, oxidation, or weathering;
• Damage to or failure of any building, equipment, substrate, fastener, anchor, supporting construction, or adjoining work furnished by others;
• Third-party products or components, which carry only the original manufacturer's warranty, if any; or
• Conditions that cannot reasonably be evaluated because the item was altered, repaired, discarded, or replaced without providing McGrath Metal the opportunity required by Section 11.
13.4 DISCLAIMER OF OTHER WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LIMITED WARRANTY IN THIS SECTION IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO ORAL STATEMENT, SAMPLE, PHOTOGRAPH, DRAWING, DESCRIPTION, OR PRIOR COURSE OF DEALING CREATES A WARRANTY BEYOND THE EXPRESS WRITTEN LIMITED WARRANTY.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MCGRATH METAL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST PRODUCTION, LOSS OF USE, BUSINESS INTERRUPTION, DELAY, ACCELERATION, DAMAGE TO OTHER WORK, OR COSTS OF REMOVAL, ACCESS, INSTALLATION, REINSTALLATION, OR SUBSTITUTE GOODS.
MCGRATH METAL'S TOTAL LIABILITY ARISING FROM AN ORDER, HOWEVER FRAMED, SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC ITEM OR SERVICE GIVING RISE TO THE CLAIM. THE EXCLUSIVE REMEDIES IN THESE TERMS APPLY UNLESS AND TO THE EXTENT A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE OR APPLICABLE LAW REQUIRES A DIFFERENT REMEDY.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited. Limitations applicable to Consumer Customers are subject to Section 16.
15. Force Majeure
McGrath Metal is not liable for delay or failure to perform caused by events beyond its reasonable control, including material shortages, supplier or transportation delays, labor shortages, unanticipated major equipment failure despite reasonable maintenance, utility interruption, fire, flood, severe weather, earthquake, epidemic, war, civil disturbance, governmental action, embargo, or other force majeure. McGrath Metal will use commercially reasonable efforts to resume performance when practicable. The affected schedule will be extended for the delay and any reasonable restart period.
16. Consumer Transactions - One-Year Limited Consumer Warranty
This Section applies only when an individual purchases new goods primarily for personal, family, or household use, including qualifying Etsy and direct retail purchases (a "Consumer Customer"). It does not apply to purchases primarily for business, trade, manufacturing, resale, construction, or commercial use. Where this Section conflicts with another provision as applied to a Consumer Customer, this Section controls.
16.1 Designation and duration
THIS IS A ONE-YEAR LIMITED WARRANTY. The warranty begins on the date the item is shipped or made available to and received by the Consumer Customer through will-call pickup, as applicable. The warranty does not restart based on later installation or use, but any tolling or extension required by applicable law applies.
16.2 What this Limited Warranty covers
For one year, McGrath Metal warrants that the consumer good will conform to the approved drawing and stated material specification, allowing for stated tolerances, standard commercial shop tolerances, and normal material and fabrication variation, and will be free from defects caused by McGrath Metal's materials or workmanship.
16.3 Implied warranties and additional legal rights
For consumer goods sold at retail in California, any implied warranty of merchantability or other implied warranty that may not lawfully be disclaimed is preserved. To the extent permitted by applicable law, the duration of any implied warranty is limited to the duration of this one-year Limited Warranty. Some states do not allow limitations on the duration of implied warranties, so this limitation may not apply.
Consumer Customers may have additional rights under the law of the state in which the goods are sold or delivered. Nothing in these Terms limits a right or remedy that cannot lawfully be waived, disclaimed, or restricted.
16.4 Making a claim and McGrath Metal's opportunity to remedy
The Consumer Customer should notify McGrath Metal promptly after discovering a claimed nonconformity and provide the order information, photographs, and a description of the condition. McGrath Metal must be given a reasonable opportunity to inspect and, where practicable, repair, alter, or replace the item before corrective work is performed by others.
McGrath Metal will commence a covered repair within a reasonable time and complete it within the period required by applicable law. If repair is not practical or does not correct the covered nonconformity after a reasonable opportunity or number of attempts, McGrath Metal will provide the replacement, reimbursement, or other remedy required by applicable law.
Use of third-party parts or services does not by itself void this Limited Warranty. However, this warranty does not cover damage caused by third-party parts, installation, modification, repair, misuse, or other excluded conduct. Unauthorized alteration may also make it impossible to determine whether the original condition was covered.
16.5 Consumer warranty exclusions
To the extent permitted by law, the exclusions in Section 13.3 apply to Consumer Customers, except that they do not exclude or limit a non-waivable consumer right. McGrath Metal does not provide installation or field services unless expressly stated in the quotation.
16.6 Consumer deposits and cancellation
For a Consumer Customer, a deposit or prepayment may be applied to the reasonable value of work already performed and costs or commitments actually incurred before cancellation, including order entry and administration, review of Customer information, shop drawings and revisions, approval processing, programming, material ordered or committed, subcontract costs, and production already performed. Those amounts may equal or exceed the deposit.
If a Consumer Customer lawfully cancels before shipment or pickup, McGrath Metal will provide any refund required after deducting amounts that may lawfully be retained or recovered. The Consumer Customer remains responsible for additional amounts only to the extent permitted by applicable law. Once custom goods have been completed and shipped or picked up, the sale is final except for rights provided by this Limited Warranty or applicable law.
16.7 Pre-sale availability
This Limited Warranty and these Terms will be made available before sale through the applicable quotation, product listing, website, electronic link, or upon request by telephone or email. A paper or electronic copy is available without charge upon request.
17. Governing Law, Venue & General Provisions
• These Terms and each order are governed by California law, without regard to conflict-of-law rules.
• For Business Customers, any action arising from an order shall be brought in the state or federal courts serving Riverside County, California. Consumer venue and jurisdiction rights that cannot lawfully be restricted remain unaffected.
• If any provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain in effect.
• A waiver on one occasion is not a waiver of the same or any other provision on another occasion.
• The accepted quotation, written order acceptance, approved drawings, written change orders, and these Terms constitute the entire agreement. In the event of a direct conflict, a later written change order or written order acceptance signed or issued by McGrath Metal controls.
• McGrath Metal may update these Terms from time to time. The version identified in or in effect on the date of the applicable quotation governs that order.
• Notices under these Terms may be delivered by email to the addresses used for the order unless a different written notice address is provided.
